Welcome to our online store. This website is owned and operated by Caroline Tindall (referred to below as "the Artist", "we", "us", or "our"). By accessing or purchasing from this website, you agree to be bound by the following Terms of Service. Please read them carefully before completing a transaction.

1. Business & Legal Identity

In terms of Section 43 of the South African Electronic Communications and Transactions Act (ECTA), our statutory disclosure identity is as follows:

2. Intellectual Property & Copyright Shield

  • Ownership of Art: All visual materials, original artwork images, fine art prints, product descriptions, and site designs displayed on this website are the sole intellectual property of the Artist. They are fully protected under the South African Copyright Act, No. 98 of 1978.

  • Usage Constraints: Buying a physical painting or a fine art print does not grant you the copyright or commercial reproduction rights to that image. You may not duplicate, resell, print, screenshot, or utilize any artwork from this site for commercial purposes or AI training datasets without explicit, signed licensing agreements from the Artist.

3. Store Products, Availability, & Commissions

  • Visual Representation: We make every effort to display the true textures and colors of our artwork as accurately as possible. However, because computer monitors and mobile screens display colors differently, we cannot guarantee that your screen's display precisely matches the physical artwork.

  • Custom Commissions: If you book a custom art commission via this website, the specific scope, payment schedule, approval checkpoints, and timeline constraints will be handled via a separate, explicit creative brief or agreement.


4. Prices, Payment, & ECTA Disclosures

  • Currency & Localization: While our base currency is South African Rand (ZAR), this website utilizes a localization currency plugin. Prices may automatically convert and display in your local geographical currency based on your IP address location for your shopping convenience.

  • Final Settlement: Please note that all transactions are processed and settled at checkout. Depending on your bank or credit card provider, your final bank statement may reflect the base transaction in South African Rand (ZAR) or incur minor international transaction conversion fees. We reserve the right to adjust pricing at any time without notice.

  • Secure Checkout: Payment processing is managed securely through authorized third-party gateways (e.g., PayFast / Yoco / Shopify Payments). We do not collect or store your private credit or debit card data.


5. Local Delivery & Courier Policy

  • Shipping Address Responsibility: Orders are dispatched inside South Africa using reliable local door-to-door courier networks. It is the customer's sole responsibility to provide an accurate, accessible physical delivery address where someone will be available to sign for the package during standard business hours.

  • Rural Shipments: Deliveries destined for deep rural zones, farm boundaries, or isolated areas may incur regional surcharge fees or require pickup from a local courier depot.

  • Damaged Shipments: In the rare event that an artwork arrives damaged due to courier handling, you must take clear photos of both the outer packaging and the artwork inside and email them to us within 48 hours of delivery so we can file an insurance claim.

6. Cancellations, Cooling-Off Periods, & Refunds

  • Returns of Original (Ready-Made) Artworks
    In terms of Section 44 of the ECTA, you have a statutory 7-day cooling-off period from the date of courier delivery to return an original, pre-made artwork. To qualify for a refund, you must notify us via email within 7 days, and you are solely responsible for booking and paying a reputable door-to-door courier service to safely return the undamaged artwork to our admin depot in its original custom packaging. Once inspected and confirmed to be in pristine, original condition, a refund will be processed

  • Exclusions (Custom & Commissioned Art): Per Section 42(2) of the ECTA, the 7-day cooling-off period explicitly does not apply to custom-made, personalized, or commissioned artworks created to your unique specifications. All deposits and final payments for custom artwork commissions are strictly non-refundable.

7. Limitation of Liability

To the maximum extent permitted by South African law, the Artist shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of this website, delayed courier deliveries, or the handling of physical artwork post-delivery.
